1. About These Terms

By browsing the site, creating an account, or placing an order, you confirm that you have read and accepted these Terms. If you do not agree with them, please do not use the site.

2. Who Can Buy From Us

You may transact on this website if you are:

• An individual aged 18 or above with the legal capacity to enter into a contract, or
• A hospital, clinic, laboratory, nursing home, diagnostic centre, dealer, or other business entity lawfully operating in India or abroad

Certain products are restricted and may only be supplied to buyers holding the relevant licence or registration — for example, a valid drug licence or a qualified medical practitioner's registration. We may ask you to provide proof before dispatching such items, and may cancel an order if the required documentation is not furnished.

3. Your Account

Registering an account lets you view pricing, place orders, and track your purchase history. You agree to provide accurate information and to keep it updated. You are responsible for keeping your password confidential and for all activity under your account. We are not liable for losses arising from unauthorised access caused by your failure to protect your credentials. We may refuse a registration, or suspend or terminate an account, where we reasonably suspect fraud, misuse, or breach of these Terms.

4. Products, Pricing & Availability

• Product photographs, descriptions, and specifications on the site are indicative. Actual packaging, appearance, accessories, and technical details may differ. Always refer to the manufacturer's original packaging, label, and instructions-for-use for complete and authoritative product information.
• Prices are listed in Indian Rupees and are inclusive or exclusive of GST as stated on the product page and invoice.
• Prices, offers, and specifications may change without prior notice. The price applicable to your order is the one confirmed at checkout.
• All items are subject to availability. Where a product becomes unavailable after your order is placed, we will inform you and offer a substitute, a credit note, or a refund.
• Despite our best efforts, occasional errors in pricing or listing may occur. Where an error is evident, we reserve the right to cancel the affected order and refund any amount paid.

5. Orders & Acceptance

Your order is an offer to purchase. A contract is formed only when we confirm dispatch of the goods. We may decline or cancel an order — before or after payment — for reasons including stock unavailability, pricing errors, incomplete regulatory documentation, delivery outside our serviceable area, or suspected fraudulent activity. Any amount already paid for a declined order will be refunded in full.

6. Payment

We accept payment through the methods shown at checkout, which may include cards, UPI, net banking, wallets, NEFT/RTGS, and (where offered) cash on delivery. Payments are processed by third-party gateways; we do not store your card or banking credentials. For approved institutional buyers, credit terms may be extended in writing, and overdue amounts may attract interest at the rate stated on the invoice.

7. Delivery & Installation

• Delivery timelines shown on the site are estimates and are not guaranteed. Delays caused by courier partners, transport disruptions, or events beyond our control are not our responsibility.
• Risk in the goods passes to you upon delivery.
• Large or capital equipment may require separate installation and commissioning, which will be scheduled with you and may be chargeable. Site readiness — including electrical supply, gas lines, flooring, and access — is your responsibility.
• Please inspect every consignment on arrival. Do not accept a package that is visibly tampered with or damaged.

8. Warranty

• Products carry the warranty offered by the original manufacturer for the period stated on the product page, invoice, or warranty card. Avishkar passes this warranty through and assists with claims.
• Warranty covers manufacturing defects only. It does not cover normal wear and tear, consumables and accessories, physical damage, misuse, unauthorised repair or modification, incorrect voltage or power supply, or damage from environmental conditions.
• Warranty service is void where the product's serial number has been removed or altered.

9. Returns & Replacements

9.1 When you can raise a request

You may request a return or replacement in the following cases:

• The product was damaged in transit
• The product has a manufacturing defect or does not function as intended
• The wrong product was delivered
• A part or accessory that should have been included is missing
• A perishable or dated product was received with less than one month of shelf life remaining

9.2 Timelines for reporting

Requests raised after these windows may not be accepted.

9.3 How to raise a request

Write to us at [support email] with your order number and invoice number, along with:

• Photographs or video showing the damage, defect, or discrepancy
• A photograph of the shipping label
• A copy of the invoice

We may seek further clarification before approving a request. Incomplete or inaccurate information may prevent us from processing your claim.

9.4 What happens next

Once approved, we will arrange collection of the product, typically within 3 working days. After our quality team inspects and approves the returned item, we will initiate a replacement — usually within 7 working days of collection. Where a replacement is unavailable, we will issue a credit note or refund. You will not be charged additional shipping for an approved replacement.

9.5 Condition of returned goods

To be eligible, returned products must be unused, undamaged, complete with all parts, accessories, manuals, and free gifts, and in their original packaging.

9.6 Items that cannot be returned

• Sterile items, single-use consumables, reagents, and cold-chain products — except where the wrong product was delivered or the item arrived damaged
• Custom-made, made-to-order, or specially procured items
• Products with customer-requested engraving, branding, or modification
• Installed capital equipment, except in the case of a manufacturing defect

We may decline a request that we reasonably determine is not genuine.

10. Cancellations

You may cancel an order within 6 hours of placing it, provided it has not been dispatched. You may also cancel if delivery is delayed by more than 21 days from the order date — this does not apply to made-to-order items, heavy equipment, furniture, or specially procured goods. Cancellation requests outside these conditions are considered at our discretion.

11. Refunds

Approved refunds are processed as follows:

• Payment gateway reversals (card, UPI, net banking) — within 7 working days of the returned goods being received or the cancellation being confirmed
• NEFT/RTGS to your bank account — within 10 working days
• Credit note — issued immediately, valid for 3 months from the date of issue

The time taken for funds to reflect in your account depends on your bank or card issuer.

12. Use of the Website

You agree not to use this website in any way that is unlawful or fraudulent, or that damages, disables, or impairs its operation or availability to others. You must not attempt to gain unauthorised access to any part of the site, introduce malicious code, or scrape, copy, or reproduce our content without written permission.

13. Intellectual Property

All content on this site — including text, product photography, catalogues, logos, and the Avishkar name and marks — is owned by or licensed to us and protected under applicable intellectual property law. You may not reproduce, distribute, or use it commercially without our prior written consent. Third-party brand names and trademarks appearing on the site belong to their respective owners.

14. No Medical Advice

Information on this website is provided for general and commercial purposes and does not constitute medical advice, diagnosis, or treatment. Medical and laboratory equipment must be selected, installed, and operated by suitably qualified persons in accordance with the manufacturer's instructions and applicable law. Avishkar is not responsible for the clinical use or application of any product supplied through this website.

15. Disclaimers & Limitation of Liability

The website and its contents are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. We do not warrant that the site will be uninterrupted, error-free, or secure, or that the information on it will be accurate or complete at all times.

To the maximum extent permitted by law, Avishkar shall not be liable for any indirect, incidental, special, punitive, or consequential loss — including loss of profit, business, or data — arising from your use of the website or the products purchased through it. Our total liability in respect of any order shall not exceed the amount paid by you for that order.

Nothing in these Terms limits liability that cannot be excluded under applicable law, including liability under the Consumer Protection Act, 2019.

16. Force Majeure

We are not liable for any failure or delay in performing our obligations where it results from events beyond our reasonable control, including natural disasters, epidemics, strikes, transport failures, regulatory action, war, civil unrest, or utility or network outages.

17. Indemnity

You agree to indemnify and hold harmless Avishkar, its directors, employees, and agents against any claim, loss, or expense arising from your breach of these Terms, your misuse of the website, or your unlawful or improper use of any product purchased from us.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified or removed to the minimum extent necessary, and the remaining provisions will continue in full effect.

19. Changes to These Terms

We may amend these Terms at any time. The revised version takes effect when published on this page. Your continued use of the website after publication constitutes acceptance of the changes.

20. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising out of or in connection with them shall first be attempted to be resolved amicably. Failing that, it shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, before a sole arbitrator, with proceedings conducted in English and the seat of arbitration at Mumbai. Subject to the above, the courts at Mumbai shall have exclusive jurisdiction.
